1. Acceptance of Terms

By creating an account, uploading floor plans, or using any ScanMyPlan service, you:

• Agree to be bound by these Terms
• Agree to our Privacy Policy
• Represent that you are at least 18 years old and have the legal capacity to enter into this agreement

2. Description of Service

ScanMyPlan provides AI-powered floor plan analysis services, including but not limited to:

• Furniture and fixture detection
• Room segmentation and analysis
• Square footage calculation
• Export of analysis results
• API access for developers

3. User Accounts

Account Registration

You must provide accurate, complete information when creating an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

Account Termination

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• You fail to pay for services

4. User Content

Your Ownership

You retain full ownership of all floor plans and content you upload ("User Content"). We process your User Content solely to provide our services.

License to Use

By uploading User Content, you grant us a limited, non-exclusive license to:

• Process your floor plans to provide the requested analysis
• Store and transmit your content as necessary for service delivery
• Use anonymized, aggregated data to improve our services

5. Prohibited Uses

You may NOT use our service to:

• Upload content that infringes intellectual property rights
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Resell or redistribute our service without authorization
• Engage in any illegal activity
• Harass, abuse, or harm others

6. Payment and Billing

Free Tier

We offer a free tier with limited usage. Terms of the free tier may change at any time.

Paid Plans

• Payment is due in advance for all paid plans
• All fees are non-refundable unless required by law
• We reserve the right to modify pricing with 30 days' notice
• Auto-renewal occurs unless you cancel before the billing cycle ends

7. API and Developer Terms

If you use our API:

• You must comply with our API documentation
• Rate limits apply and may be adjusted
• You may not exceed your allocated usage without authorization
• You are responsible for your API integrations

8. Disclaimers

OUR SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

We make no warranties, express or implied, regarding:

• The accuracy or reliability of analysis results
• The availability or uptime of our service
• That our service will meet your specific requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from your use or inability to use our service
• Any act or omission of third parties

Our total liability shall not exceed the amount you paid for our services in the 12 months preceding the claim.

You agree to indemnify and hold harmless ScanMyPlan and its officers, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your use of our service
• Your User Content
• Your violation of these Terms

11. Intellectual Property

The ScanMyPlan service, including our website, AI models, algorithms, and all related technology, are owned by ScanMyPlan, Inc. and protected by copyright, trademark, and other laws.

12. Third-Party Services

Our service may include links to third-party websites or services. We're not responsible for the content or practices of these third parties.

13. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms will be resolved through binding arbitration in San Francisco, California, in accordance with AAA rules.

15. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes. Your continued use of the service after such notice constitutes acceptance.

16. General Provisions

• Severability: If any provision is found unenforceable, the remaining provisions will remain in effect
• Waiver: Our failure to enforce any right does not constitute a waiver
• Entire Agreement: These Terms constitute the entire agreement between you and us
• Assignment: You may not assign these Terms without our consent
